1. General Provisions
1.1. Examia is an online platform that utilizes artificial intelligence to analyze documents and generate educational materials, such as tests and quizzes.
1.2. By using the Service, you confirm that you are at least 18 years old or have permission from a legal guardian.
2. User Accounts
2.1. To access certain features, you must create an account.
2.2. You are solely responsible for maintaining the security of your password and for all activities that occur under your account.
3. User Content and Data Privacy (Crucial)
3.1. You retain all ownership rights to the documents and materials you upload to the Service.
3.2. No Data Training Policy: We value the intellectual property of educators. Examia uses the OpenAI API to provide its services. Under our enterprise-grade integration, none of the documents, texts, or private data you upload are used to train, retrain, or improve the global OpenAI models. Your data remains private and is used solely to generate results for your specific request.
3.3. By uploading content, you grant Examia a limited, non-exclusive license to process your data only for the purpose of providing the service to you.
4. AI-Generated Content
4.1. You own the output (tests, quizzes) generated by Examia. You are free to export and use them for personal or institutional purposes.
4.2. Disclaimer of Accuracy: AI-generated content may contain inaccuracies. Examia does not guarantee 100% accuracy of the generated questions. The User is responsible for reviewing and validating the final result before using it in an educational setting.
5. Payments and Subscriptions
5.1. The Service is provided on a subscription basis (Scholar, Professor, Institution packages).
5.2. You agree to pay all fees associated with your chosen plan. Payments are non-refundable after the service usage has commenced, except where required by law.
5.3. Examia reserves the right to modify pricing with a 30-day notice to active users.
6. Acceptable Use
6.1. You agree not to use the Service to:
- Generate illegal, offensive, or harmful content.
- Attempt to bypass security measures or overload our API infrastructure.
- Create automated scripts for unauthorized data scraping.
7. Limitation of Liability
7.1. The Service is provided "as is." We are not liable for any direct or indirect damages arising from your use or inability to use the Service.
8. Amendments
8.1. We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes your acceptance of the new Terms.
